What This Policy Covers

Film Faster is a platform where members upload scripts, films, look books, pitch materials, and other creative content. Under the DMCA, online service providers that host user-generated content may qualify for "safe harbour" protection from copyright infringement claims, provided they:

  1. Publish a DMCA takedown policy
  2. Designate an agent with the Copyright Office
  3. Respond expeditiously to valid takedown notices
  4. Terminate repeat infringers in appropriate circumstances

This policy describes how Film Faster handles each of these.

Filing a Takedown Notice

To submit a copyright takedown notice, the notice must include the following elements required by 17 U.S.C. § 512(c)(3)(A):

  1. Signature. A physical or electronic signature of the copyright owner, or a person authorized to act on behalf of the owner.

  2. Identification of the copyrighted work. A description of the copyrighted work that you claim has been infringed. If multiple works are involved, you may provide a representative list.

  3. Identification of the infringing material. A description of the material that you claim is infringing, including the specific URL(s) or location(s) on the Film Faster platform where the material can be found. This must be specific enough for us to locate the material.

  4. Contact information. Your mailing address, telephone number, and email address.

  5. Good faith statement. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

  6. Accuracy and authorization statement. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

How to submit: Send the notice to the Designated Agent above, by email to xavierfilm@yahoo.com with the subject line "DMCA Takedown Notice", or by mail to the address above.

What Happens After a Notice Is Received

  1. Review. Film Faster reviews the notice to confirm it contains all required elements under § 512(c)(3). If the notice is incomplete, we will request the missing information.

  2. Takedown. If the notice is complete and valid, Film Faster will expeditiously remove or disable access to the identified material.

  3. Notification to the member. Film Faster will notify the member who uploaded the material that it has been removed or disabled, along with the reason and a copy of the takedown notice (or a summary).

  4. Record-keeping. The takedown notice and the platform's response are recorded in the moderation system. Reports of intellectual property infringement are routed through the same moderation queue as all other reports, using the "Intellectual property or copyright" report category.

Counter-Notice

If a member believes their material was removed or disabled as a result of a mistake or misidentification, they may submit a counter-notice under 17 U.S.C. § 512(g)(3). A valid counter-notice must include:

  1. Signature. A physical or electronic signature of the member.

  2. Identification of the material. A description of the material that was removed and the location at which it appeared before removal.

  3. Good faith statement. A statement, made under penalty of perjury, that the member has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.

  4. Contact and jurisdiction information. The member's name, address, and telephone number, and a statement that the member consents to the jurisdiction of the Federal District Court for the judicial district in which the member's address is located (or, if the member's address is outside the United States, any judicial district in which Film Faster may be found), and that the member will accept service of process from the person who submitted the takedown notice or that person's agent.

How to submit a counter-notice: Send the counter-notice to the Designated Agent above, by email to xavierfilm@yahoo.com with the subject line "DMCA Counter-Notice", or by mail to the address above.

What happens next: If Film Faster receives a valid counter-notice, we will forward it to the person who submitted the original takedown notice. Film Faster will restore the material within 10 to 14 business days after receiving the counter-notice, unless we first receive notice from the original complainant that they have filed a court action seeking to restrain the member from engaging in infringing activity.

Repeat Infringer Policy

Film Faster will, in appropriate circumstances, terminate the accounts of members who are determined to be repeat infringers of copyright. A "repeat infringer" is a member whose account has been the subject of two or more valid takedown notices within a 12-month period.

Termination decisions are made by the moderation team based on the totality of circumstances, including the validity of the notices, the nature of the material, and whether the member has submitted counter-notices. Terminated members may appeal the decision through the platform's appeal process at /appeal.

False Claims

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability. Film Faster takes false claims seriously and may take action against parties who submit fraudulent takedown notices or counter-notices.

Connecting to the Moderation System

Reports of intellectual property infringement on Film Faster are handled through the platform's standard moderation system. Members and rights holders can report infringing content by using the "Report" function on any content page and selecting the "Intellectual property or copyright" category. This creates a report in the same moderation queue used for all other reports, ensuring consistent handling, tracking, and accountability.

Formal DMCA notices should be sent to the Designated Agent as described above. DMCA notices follow the legal process described in this policy, while reports filed through the Report function follow the platform's community standards process.
